Based on Article 22 (Seniority) of the 2024–2029 Collective Bargaining Agreement

 

 

 

 

Seniority

 

 

 

 

 

Q: What determines seniority?

 

 

Answer:

 

Seniority is based on your continuous service from your last date of hire.

 

Seniority affects:

 

  • Layoff order

  • Recall order

  • Vacation selection

  • Pick order

  • Other contract-based preferences

 

 

 

 

 

Q: When can seniority be broken?

 

 

Answer:

 

Seniority is broken if an employee:

 

  • Resigns

  • Retires

  • Is discharged

  • Transfers permanently out of the bargaining unit

  • Fails to return from layoff within required timeframe

Layoffs

 

 

 

 

 

Q: How are layoffs determined?

 

 

Answer:

 

Layoffs are based on inverse seniority.

 

This means employees with the least seniority are laid off first.

 

 

 

 

Q: Can full-time employees be laid off while part-time employees remain working?

 

 

Answer:

 

No.

 

The Agreement requires that part-time employees be laid off before full-time employees.

 

 

 

 

Q: Do employees continue to accrue benefits while laid off?

 

 

Answer:

 

No. Employees do not accrue benefits while on layoff status.

 

 

 

 

Q: Can maintenance employees displace other employees during layoff?

 

 

Answer:

 

Yes.

 

Maintenance employees may exercise displacement (bumping) rights based on seniority.

 

Employees must exercise displacement rights within two (2) days.

Recall

 

 

 

 

 

Q: How does recall from layoff work?

 

 

Answer:

 

Employees are recalled in seniority order.

 

The most senior laid-off employee is recalled first.

 

 

 

 

Q: How long do I have to respond to a recall notice?

 

 

Answer:

 

You must report within five (5) working days after receiving recall notice.

 

Failure to report within this timeframe may result in loss of seniority.

 

 

 

 

Q: What happens if I fail to return from recall?

 

 

Answer:

 

Failure to return within the required timeframe may result in termination and loss of seniority rights.

 

 

 

 

Important Notes

 

 

  • Layoffs follow inverse seniority.

  • Part-time employees are laid off before full-time employees.

  • Displacement rights must be exercised promptly.

  • Recall response deadlines are strict.

  • Missing recall deadlines may permanently break seniority.
